Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and SimplySite Reports ("SimplySite Reports," "we," "us," or "our") governing your use of the SimplySite Reports application, website, and related services (collectively, the "Service"). By creating an account, subscribing, or using the Service in any way, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. The Service
SimplySite Reports is a documentation tool for field inspections. It lets you capture photos and videos, mark up floor plans, record notes and locations, and generate reports and export bundles. The Service is a documentation aid only. It does not perform inspections, render professional opinions, or verify the accuracy, completeness, or code compliance of anything you record.
Optional third-party integrations. The Service offers an optional integration with Procore, a third-party construction management platform, available on the Pro plan. If you choose to connect your Procore account, you authorize us to access your Procore account on your behalf (via Procore's standard authorization process) to import project details you select, to file reports and export bundles you direct us to file into your Procore project documents, and to record entries you create in the app into your Procore project (such as inspection checklist responses, observations, punch items and their photos, and daily log entries). Every action is performed with your own Procore credentials and is limited by the permissions your Procore administrator has granted your Procore account; the Service cannot do anything in Procore that your own Procore account could not do. Procore is an independent service governed by its own terms and privacy policy; we are not responsible for Procore's availability, conduct, or handling of content once it is delivered there. You can disconnect the integration at any time from within the app. "Procore" is a trademark of Procore Technologies, Inc.; SimplySite Reports is not affiliated with or endorsed by Procore Technologies, Inc.
2. Eligibility and Accounts
- You must be at least 18 years old and able to form a binding contract to use the Service.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- You agree to provide accurate account information and to notify us promptly of any unauthorized use of your account.
3. Subscriptions, Trials, and Billing
- The Service requires a paid subscription (currently Basic at $9.99/month, Premium at $19.99/month, and Pro at $29.99/month, subject to change). Plan features and limits are described in the app at the time of purchase.
- New accounts receive a free trial (currently 30 days, no credit card required, limited to one trial per account) with Pro-level access. When the trial ends, access pauses until you choose a paid plan — you are never charged automatically, because no payment method is collected during the trial.
- Subscriptions renew automatically each billing period until canceled. You can cancel anytime through the billing page in the app; cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable and no credit is given for partial periods.
- Payments are processed by our payment provider (Stripe). We do not store your full card details.
- We may change subscription pricing or features with reasonable advance notice; changes apply at your next renewal.
4. Your Content
- You retain ownership of the photos, videos, floor plans, notes, and reports you create with the Service ("Your Content"). Your inspection content is stored on your device; we do not host it on our servers except transiently where needed to deliver an export you request.
- You are solely responsible for Your Content, including having the legal right to photograph and document the sites you inspect, and for backing it up. Deleting the app, clearing browser data, losing your device, or deleting your account may permanently destroy Your Content, and we have no ability to recover it.
- You grant us only the limited rights needed to operate the Service (for example, processing an export you request).
- If you use the Procore integration, reports you file to Procore and entries you record there (inspection responses, observations, punch items, photos, and daily log entries) are transmitted at your direction to your own Procore project. Report and bundle files are uploaded directly from your device to Procore's storage service; their contents do not pass through our servers (except transiently, never retained, in the rare fallback case where a direct upload cannot complete). If a Procore entry cannot be delivered right away (for example, while offline), the app keeps it on your device and retries until it is delivered or you discard it. Once delivered, that content resides in Procore and is governed by your agreement with Procore and your company's Procore permissions — removing it from Procore is up to you and your Procore administrators.
5. Professional Responsibility — No Professional Advice
Reports generated by the Service are prepared by you, not by us. The Service does not provide engineering, architectural, construction, safety, legal, insurance, or any other professional advice. You are solely responsible for the accuracy, completeness, and professional adequacy of every report you produce and distribute, for complying with the licensing, inspection, and reporting standards that apply to your trade and jurisdiction, and for any decision anyone makes in reliance on your reports. GPS coordinates, auto-placed pins, and location tags are approximate and depend on device hardware and signal conditions; verify locations independently before relying on them.
6. Acceptable Use
You agree not to: (a) use the Service for any unlawful purpose, including documenting property you have no right to access; (b) attempt to bypass subscription limits, payment requirements, or security measures; (c) reverse engineer, copy, resell, or create derivative works of the Service; (d) upload malicious files or interfere with the operation of the Service; or (e) use the Service to infringe anyone's privacy, intellectual property, or other rights.
7. Intellectual Property
The Service, including its software, design, logos, the "SimplySite Reports" name, and the tagline "document, describe, deliver. Simply.", is owned by us and protected by intellectual property laws. Except for the limited right to use the Service under these Terms, no rights are granted to you. You may not use our names, marks, or branding without prior written permission.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT REPORTS, GPS DATA, MEASUREMENTS, OR ANY OTHER OUTPUT OF THE SERVICE WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, BUSINESS, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND (b) OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
10. Indemnification
You agree to defend, indemnify, and hold harmless SimplySite Reports and its owners, officers, employees, contractors, and agents from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) Your Content, including any report you generate or distribute; (b) your inspections, site visits, or professional services; (c) your violation of these Terms or of any law or third-party right; or (d) any dispute between you and your clients or other third parties.
11. Termination
You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate your access if you violate these Terms, misuse the Service, or fail to pay applicable fees. Sections 4–10 and 12–13 survive termination.
12. Changes to the Service or These Terms
We may modify the Service or these Terms from time to time. If we make material changes to these Terms, we will post the updated Terms with a new "Last updated" date and, where appropriate, provide additional notice. Continuing to use the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing Law and Disputes
These Terms are governed by the laws of the United States and the state in which SimplySite Reports is organized, without regard to conflict-of-law rules. You agree that any dispute will be resolved in the state or federal courts located in that state, and you consent to their jurisdiction. To the extent permitted by law, each party waives any right to a jury trial and agrees claims may only be brought individually, not as part of a class action.
